Daily Fantasy Sports in Kentucky

Daily Fantasy Sports (DFS) are currently unregulated in the state of Kentucky. However, HB 106 also makes provisions for this industry. According to the legislation, DFS contests would become legal while DFS operators would need to be licensed by the state before offering their products in Kentucky.

If the bill passes the Senate and is signed into law, we can expect to see the main players such as DraftKings, FanDuel, Yahoo Sports, and Monkey Knife Fight enter the market.

What About Online Poker in Kentucky?

It once seemed unlikely that legalized online poker would ever become a reality in Kentucky any time in the near future. This was due to the fact that previous Governor Steve Beshear took definitive action against 140 gambling-related domains including PokerStars and Bodog back in 2008. The legal wrangling that ensued was messy to say the least and took over a decade to follow due process in the courts.

While the majority of those cases are now settled, it still seemed unrealistic to hope that the current Governor (Beshear’s son Andy) would take a more lenient approach to the game. However, the sports betting bill that has passed through the House also includes provisions for establishing a regulated online poker market and the Governor has intimated that he will sign any bill that passes through both chambers.
