Everi Payments Inc., the fintech subsidiary of casino gaming provider Everi Holdings Inc. has announced that it has won a patent lawsuit following a ruling by the Patent Trial and Appeal Board (PTAB).
The lawsuit was filed in the U.S. District Court for the Western District of Texas in September 2021 by Sightline Payments. The company alleged that Everi’s ‘Cash Club Wallet’ infringed on five patents held by Sightline.
The case was dismissed on June 1st, 2022 by U.S. District Judge Alan Albright. However, Sightline chose to appeal the ruling and asked that the PTAB review the case.
The PTAB began its review in August of 2023 and has now issued five Final Written Decisions. These decisions state that all of the patent claims asserted by Sightline against Everi were “unpatentable” as obvious. In its ruling the PTAB stated that it could find no clear infringments made by Everi’s ‘Cash Club Wallet’.
Speaking of the ruling Kate Lowenhar-Fisher, Chief Legal Officer of Everi, said:
“Everi is gratified that after reviewing all of the facts and testimony, the PTAB found in our favor. As with all litigation there is uncertainty and additional appeals may be forthcoming.
