Montana Bill Defines Legal Gambling, Increases Criminal Penalties

Montana Senator Vince Ricci introduced Senate Bill 555 on Thursday to redefine the definition of “internet gambling” in the Montana Code of Annotated, extend additional enforcement powers, and increase criminal penalties for those who illegally gamble online in the Big Sky Country.

SB 555 describes “gambling device” as “a mechanical, electromechanical, or electronic device, machine, slot machine, instrument, apparatus, contrivance, scheme, or system used or intended for use in any gambling activity.”

The definition of “internet gambling” would expand to include online casinos and any other form of mobile wagering with conventional money, electronic payment methods, or cryptocurrency.

“Antique gambling device” means “an illegal gambling device manufactured prior to 1994” or “any gambling device which, at any present time, is 30 years old or older.”

SB 555 also defines “gambling” or “gambling activity” as “risking any money, credit, deposit, check, property, or other thing of value for a gain that is contingent in whole or in part upon lot, chance, or the operation of a gambling device or gambling enterprise.”

In addition, the measure doesn’t alter the terms of other forms of legalized gambling already allowed in Montana, such as certified video gambling devices, live card tables, charity raffles organized by organizations, or games of chance operated on Indian reservations by tribal regulations.

Online Casinos That Do Not Accept Currency Of Any Kind Can Continue To Operate In Montana

Online casinos that do not allow the use of currency of any kind can continue to operate in Montana since they’re “not considered a gambling activity.” That means free-to-play social casinos or sweepstakes casinos are technically off the hook since they operate in gray area.

The terms “gambling” or “gambling activity” would exclude promotional games of chance; amusement games regulated by Title 23, chapter 6, part 1; and social card games of bridge, cribbage, hearts, pinochle, pitch, rummy, and solo. Games played solely for prizes of minimal value are allowed.

As for stricter criminal penalties, residents who knowingly solicit or advertise participation in illegal gambling activities could be charged with misdemeanors.

Individuals who run illegal online gambling operations in Montana directly or indirectly through offshore operators would face felony charges. Offenses under these new laws could be penalized by fines of up to $50,000, 10-year sentences, or both.

More importantly, the Dept. of Justice would revoke any of the convicted parties’ gambling licenses or permits and issue violators a lifetime ban to prevent them from ever obtaining gaming licenses.
