The Dutch gambling regulator, de Kansspelautoriteit (KSA), has announced that it will now collect pending financial penalties to the sum of €4,410,000 from online gambling operator Gammix LTD.
On the 22nd June, 2022, the KSA warned Gammix that it must withdraw its unlicensed gambling services from the Dutch market or face a penalty of €1,470,000 for each week it remained in service up to a maximum of €4,410,000. According to the KSA’s announcement, the company was found to have allowed consumers in the Netherlands to access its websites and place illegal wagers at its websites Nordslots.com and Rantcasino.com.
At the time, Gammix disputed the potential penalties. However, the KSA rejected its appeal and following several checks, it was discovered that players within the Netherlands were still able to access the platform and place bets despite the warnings. As a result, the KSA has decided to collect the fines in full.
Gammix will be allowed the opportunity to challenge the decision to collect the financial penalties.
René Jansen, chairperson of the KSA said:
‘We have to press ahead when combating illegal supply. An order subject to periodic penalty payments is often effective within administrative law to stop a violation. Not in this case, because the violation has not completely ceased, so we take the next step. We do not want an order subject to periodic penalty payments to be ignored, because that would make the remedy less effective. Anyone who violates and continues to continue must pay. It’s that simple.’
This brings the total fines for 2023 to more than €16.8 million while the KSA’s fines make up €7.4 million of that figure.
Gambling industry fines in 2022 came to €251,712,034 / $269,532,490 – a significant increase of 443.9% compared to 2021’s total of €44,753,969 / $48,642,992.
