In March 2018, West Virginia lawmakers passed Senate Bill 415 that legalized sports betting within the state. However, that legislation didn’t become active until May 14th, 2018 when the Supreme Court ruled that the the Professional and Amateur Sports Protection Act of 1992 (PASPA) was unconstitutional following a legal challenge by the state of New Jersey. This lifted the federal ban on sports betting giving individual states the power to launch and regulate their own markets.
The West Virginia Lottery Commission was tasked with drafting a regulatory framework for sports betting with a target launch date of some time prior to the 2018-19 NFL season. The Commission met its target and the Hollywood Casino at Charles Town accepted the first legal sports bets in the state on August 30th 2018.

Mobile sports betting launched in West Virginia in December 2018 through the BetLucky app. However, this wasn’t to last long and by March 2019, BetLucky had ceased its West Virginia operations. The issue arose because of a dispute between Delaware North and sports betting provider Miomni. The issue not only stalled mobile operations but also caused both the Mardi Gras and Wheeling Island retail sportsbooks to shut temporarily.
Six months later, mobile sports wagering returned to West Virginia when FanDuel and DraftKings launched.
Daily Fantasy Sports in West Virginia
In 2016, West Virginia’s Attorney General issued an opinion in that effectively opened the door to daily fantasy sports (DFS) in West Virginia. The opinion came as a result of Senate Bill 529 and stated that fantasy sports contests were “not decided predominantly by chance”, and therefore were not illegal gambling under West Virginia state law.
However, there is no formal legislation for DFS operations meaning that there is no list of licensed and approved operators in the state.
What About Online Poker in West Virginia?
While online poker is technically legal in the state of West Virginia, there are no licensed online poker platforms currently operating in the state. At present, sweepstakes and social poker games are the only online poker options available.

On Friday, February 23rd, the West Virginia Responsible Gaming and Research Act passed the House Judiciary Committee.
The Responsible Gaming and Research Act (RGRA) mandates that gambling operators in West Virginia provide anonymized data relating to their customers to West Virginia University. WVU will then collaborate with the State Lottery Commission’s Department of Human Services to analyze the data.
