Washington Sports Betting

On March 25th 2020 sports betting was legalized in Washington state as Governor Jay Inslee signed HB2638 into law. The bill allows for sports wagering at Class III tribal casinos. This made the state the first to legalize sports betting in 2020. While the bill allows for retail sports betting, mobile betting can only take place on tribal lands.

However, according to state law the casino operators cannot be taxed on sports betting revenue meaning that the state has missed out on a potentially lucrative revenue stream.

The industry has been held up by delays relating to the regulation of the industry and issues with existing gaming compacts. These have since been ironed out and the industry launched on September 9th 2021.

Who regulates the Washington sports betting industry?

The Washington State Gambling Commission oversees the state’s sports betting industry and recently approved a new set of rules and regulations which will come into effect on the 30th of August 2021.

Which sportsbooks are legal in Washington?

The Washington State Gambling Commission opened the license application process in early August and could be in a position to issue license by August 30th when the new rules and regulations come into place.

There are currently 16 tribes that have signed a compact with the state allowing them to apply for sports betting licenses.

The Snoqualmie Tribe partnered with IGT to launch a retail sportsbook becoming the first legal sportsbook in the state of Washington.

Mobile sports betting in Washington

Mobile sports betting is allowed but only when the gambler is physically located in a tribal casino. This means that it is highly unlikely that any major online sports betting operators will enter the local market.

Daily Fantasy Sports in Washington

Daily Fantasy Sports (DFS) contests are illegal under Washington state law. In 2016, the state ruled that DFS contests were not exempt from the state’s anti-gambling laws and therefore illegal.

There are currently no operators servicing the state and there is no indication that DFS legislation will be introduced at any point in the near future.

What about online poker in Washington?

Washington law specifically states that online poker is illegal. In 2006, the state amended gambling laws to include all forms of online gambling and this amendment has remained in place ever since.

There have been several attempts to pass legislation in the years since but no bills have ever gained sufficient support. With tribal casinos now controlling the majority of Washington betting activity, it’s unlikely that the tribes will allow online casino or poker legislation to pass without a fight.
